These answers do not replace the advice of an attorney, so you still need to consult an attorney as to the specifics regarding your case. Cases are time sensitive and you may lose the right to file if you do not exercise your right in a timely fashion, so please call our office ASAP!<\/p>\n\n\n\n<p><em><strong>Will I be fired for filing a claim?<\/strong> <\/em><\/p>\n\n\n\n<p>It is against the law to fire an employee for filing a worker\u2019s compensation claim. Most law abiding employers know it is illegal to fire an employee because of his or her intentions to file a workers\u2019 compensation claim. Still, there are some employers that do not know that it is illegal to fire the employee for this reason. If this happens, and the employee has a lawyer, many times all it takes is a letter from the attorney to the employer advising the employer of the prohibition for such wrongful termination. Therefore, the employee is reinstated with his or her job. Most times, employers that do fire a worker who has reported an injury (and\/or filed for worker\u2019s compensation) do so under the basis that the employee violated company policy somehow. (For example, they didn\u2019t follow the safety guidelines in their company handbook, or didn\u2019t wear safety goggles, etc.) If this happens, come speak with us right away so we can address the problem early.\u00a0 <\/p>\n\n\n\n<p><strong><em>How long will it take for my case to be resolved?<\/em> <\/strong><\/p>\n\n\n\n<p>Each case has its own set of circumstances, so it\u2019s difficult to give a fair, accurate answer without looking at your case specifically. However, generally speaking, cases are normally resolved within 9 months of being discharged by one of the agreed upon doctors, when you\u2019re considered \u201cPermanent and Stationary.\u201d Permanent and Stationary (P&amp;S) means that your condition has been stabilized and considered treated to the extent of current medical science. For some people, this could take a while, as everybody heals at a different rate, and no one\u2019s injury or illness is quite the same. Some cases go on for years. The majority of our cases last at least two years, but it may not be so for your case.<\/p>\n\n\n\n<p><strong><em>What if I am unable to return to work? <\/em><\/strong><\/p>\n\n\n\n<p>If you are unable to return to work because of your disability resulting from your work related injury, then the next course of action is to apply for Social Security benefits. We can help you in this regard, as well. If you are able to work in some other field, the insurance company is required to provide you with funds to go towards learning a new trade to accommodate your new work restrictions.<\/p>\n\n\n\n<p><strong><em>Who will pay for my medical bills? <\/em><\/strong><\/p>\n\n\n\n<p>Your employer is required to have worker\u2019s compensation insurance. The insurance company will pay for your medical bills and reimburse you for mileage.<\/p>\n\n\n\n<p><strong><em>How much will this cost me?<\/em><\/strong><\/p>\n\n\n\n<p>Leo generally charges the standard attorney\u2019s fee of 15% of the final settlement total, but this amount is contingent on the WCAB judge&#8217;s approval, which they provide on a case by case basis. Rather, when the case is settled, the fee will be deducted from the settlement the insurance company pays. You don\u2019t have to pay for anything out of pocket.<\/p>\n\n\n\n<p><strong><em>Can I choose what doctor to go to?<\/em><\/strong><\/p>\n\n\n\n<p>For most individuals, medical care is received through the insurance company&#8217;s Medical Provider Network (MPN), who has to pre-authorize the treatment. The doctors available on this list changes frequently and you may need to check the insurance company&#8217;s website to determine who is actively a part of the list.<\/p>\n\n\n\n<p>If you go to your own private doctor, that comes out of your own funds and is not subject to reimbursement.&nbsp;<\/p>\n\n\n\n<p>There are also QMEs (Qualified Medical Examiners) that are selected by the Division of Workers\u2019 Compensation. These doctors are not available to provide treatment, but rather to conduct an exam and produce their medical findings to the attorneys.&nbsp;<\/p>\n\n\n\n<p>Our office will help coordinate appointments as needed.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<p><strong><em>\u00a0\u00bfCu\u00e1nto tiempo tomar\u00e1 para que su caso de compensaci\u00f3n a mis trabajadores a presentarse?<\/em><\/strong>\u00a0<\/p>\n\n\n\n<p>Leo presenta normalmente sus casos a la semana despu\u00e9s de su nombramiento inicial. La mayor\u00eda de los empleadores respetuosos de la ley saben que es ilegal despedir a un empleado debido a sus intenciones de presentar un reclamo de compensaci\u00f3n para trabajadores. Sin embargo, hay algunos empresarios que no saben que es ilegal despedir al empleado por esta raz\u00f3n. Si esto sucede, y el empleado tiene un abogado, muchas veces s\u00f3lo se necesita una carta del abogado para el empleador asesorar al empleador de la prohibici\u00f3n de tal despido injustificado.
